Competition Terms & Conditions

1) Prize

A) The Major prize is for a 1 hour portrait photography session at either Largs Bay, Blackwood Forest or Veale Gardens, Full Digital Gallery and a $550 Print Credit.
Print Credits are to be used for Albums, Folios, Montage Frames & Wall Art purchases only. Must be used at the time of design appointment, not vailed on future purchases and not redeemable for cash.
Any products outside or additional to the Prize such as additional photographic products are available for purchase by the Client at an additional cost and at the Client’s expense.

B) The Runner up prize is for a 1 hour portrait photography session at a outdoor location within 30min drive of Adelaide’s CBD, $250 voucher for use towards digital file collections and a 8 x 12inch framed print of the Client’s choice.
Prize does not include digital files or galleries, these products are for purchase prior to the shoot taking place.
Any products outside or additional to the Prize such as additional photographic products are available for purchase by the Client at an additional cost and at the Client’s expense.

2) Session Bookings

A) The Client acknowledges and agrees that the Prize is for use before May 31st 2025, failure to book and attend session will result in the client forfeiting the prize.

B) The Client acknowledges and agrees that this Prize is for the date and venue agreed upon when accepting the prize, and that any change of date or venue may result in the Client forfeiting the Prize unless agreed upon with photographer.

C) The Client acknowledges and agrees that the Photographer is the sole Photographer allowed to photograph the session.

3) Style & Approach

The Clients acknowledge and agree that:

a)  the Photographer has a distinct style and approach to photography, and the Client is aware of and familiar with and accepts this style and approach; and

b)  the Photographer will, at times, be required to make a variety of photographic decisions and use a variety of photographic techniques in order to best convey the emotion of the shoot.

4. Liability & Disclaimer

a)  In the Event the Photographer is unable to provide the photography services on the Event Date pursuant to this Agreement (in circumstances including but not limited to illness, injury, incapacity, family emergencies, health reasons, scheduling conflicts, flood, fire, storms, acts of God or other circumstances beyond the Photographer’s control the Photographer reserves the right to:

  1. Reschedule the Session

  2. Terminate this Agreement

  1. b)  All reasonable care will be taken by the Photographer when taking, storing, editing, printing, mailing, transporting and delivering digital and physical products. The Client hereby releases to the fullest extent permitted by law the Photographer from all claims, losses, costs, damages and actions incurred or brought against the Photographer directly or indirectly in relation to damage, impaired quality or loss of photographic materials in processing, through camera or equipment malfunction or otherwise.

  2. c)  The Photographer strives to keep backups and archival storage media of all Events photographed. However, due to the unpredictability of data, storage options and other uncontrollable circumstances, the Photographer cannot guarantee the retention of the photographs of the Session after they have been provided to the Client. It is recommended that the Client make duplicates of the photographs on the disc or USB provided by the Photographer to the Client (for backup purposes) as well as backups on computer hard drive removable storage media. It is the Client’s responsibility to take good care of all products provided by the Photographer to the Client for future years.

  3. d)  You agree that the Photographer will have no liability in respect of this Agreement except as specified herein.

5. Rights, Copyright & Intellectual Property

a) The Client acknowledges and agrees that copyright to all Photography Products is and remains the property of the Photographer at all times. The Client is granted printing rights in relation to the Photography Products for personal, non-commercial purposes only. Personal, non- commercial purposes include the use of the printing, enlarging, compiling in albums, framing and display of Photography Products for personal purposes by the Client and the family and friends of the Client but excludes any commercial purposes whatsoever.

b)  Any Photography Products are legally regarded as intellectual property, and these Photography Products remain the property of the Photographer, including the right to reproduce them for any purpose deemed proper by the Photographer in its absolute discretion (including, but not limited to, advertising, marketing, display, portfolio viewings, social media). Any or all Photography Products may be used by the Photographer for the aforementioned purposes.

c)  The Client must not submit, cause, or allow any third party to submit or cause, any of the Photography Products to be published including but not limited to in any bridal magazines, newspaper or blogs without the prior written consent of the Photographer and such consent may be granted subject to conditions in the Photographer’s absolute discretion.

d)  Photography Products must not:

  • be sold (whether in digital or printed form), or redistributed for any kind of monetary or non-monetary profit or gain;

  • be credited artistically to any other business, company or persons;

  • be uploaded to any website photo storage system that assumes copyright of the images uploaded by its users, provides those images for sale or download to other internet users, or provides the images in any royalty-free or redistribution capacity. Note that Clients and the Client’s families and friends are fully responsible for reading the terms and conditions of any such website prior to uploading the Photography Products. The Client will be liable for any liability for the breach of this clause, and any consequences arising from the breach.

e)  The Client will use best endeavours to prevent family or friends who come into possession of the Photography Products or any reproductions of the Photography Products from using them in a way not permitted under this Agreement.

6. Production of Final Work

a)  Once the Client have provided written Approval regarding the printing of album or print products, the order cannot be changed or cancelled. The Client is responsible for checking the accuracy of all details, including but not limited names and dates on album covers.

b)  For custom designed albums the initial design and 1 round of changes are included in the Price. Any changes requested beyond this will incur additional fees.

c)  Exact colour-matching in photographs cannot always be guaranteed, though reasonable efforts will be made to do so.

d)  All images are digitally enhanced and individually checked and adjusted. Retouching is provided at no additional cost to the Client. However, should the Client require intensive retouching beyond standard practice, an additional fee may be charged, at the discretion of the Photographer.

e)  The Client acknowledges and agrees that the Client is contracting the Photographer for its technical and artistic expertise; that any artistic or technical interpretations made by the Photographer will be deemed acceptable and correct; and that the Photographer reserves the right to post-process the images as it deems appropriate and artistically suitable. Images will be edited in a mix of colour and black and white depending on which is more suited to the individual image and lighting.

Definitions

In this Agreement the following expressions shall have the following meanings unless the context requires otherwise:

Agreement means this Agreement.

Approval has the meaning ascribed to that term in clause of this Agreement.

Balance means the Balance of the Price as noted in this Agreement.

Balance Due Date means the due date for payment of the Balance as noted in this Agreement.

Client means the person, couple or family participating in the session

Deposit means the Deposit referred to in this Agreement.

Deposit Due Date means the due date for payment of the Deposit as referred to in this agreement.

Entry Form means the form completed by or on behalf of the Client and submitted to the Photographer in relation to the Prize.

Event means the Event referred to in this Agreement.

Event Date means the date of the Event as referred to in of this Agreement.

Nominated Contact means the contact person referred to in this Agreement.

Notice Period has the meaning ascribed to that term in clause of this Agreement.

Package means the Package referred to in this Agreement.

Photographer means the photographer referred to in this Agreement and includes any employees, assistants, agents and contractors of the Photographer.

Photographic Products means any photographs, images or associated products created, prepared, produced and/or provided by the Photographer.

Price means the Price noted in this Agreement.

Travel/Accommodation Fee means the fee referred to in this.
